Jensen Beach gave its name to a stretch of protected water. The Jensen Beach to Jupiter Inlet Aquatic Preserve begins here and covers about 23,000 acres of the Indian River Lagoon through Martin, St. Lucie, and Palm Beach counties. In 2004, two hurricanes came ashore within three weeks of each other at the southern end of Hutchinson Island, just east of Stuart. Frances landed on September 5. Its seawall checklist requires a DEP permit or exemption for construction on the water, sealed engineering drawings, and a survey with NAVD elevations. New seawalls also need an environmental waiver from the county's Growth Management Department.
On the state side, Florida law limits new vertical seawalls in estuaries and lagoons to existing man-made canals already lined with vertical walls. Restoring a wall at its old location, or within 18 inches waterward, is exempt from a Chapter 403 permit. That's one reason repairs are usually the simpler route here.
